Trespass Arrest Authorization

A Trespass Arrest Authorization allows the Walnut Creek Police Department to enforce trespass laws on your property without you present. It authorizes officers to warn, cite, or arrest trespassers on commercial, vacant, or properly posted properties, helping deter issues such as loitering, illegal dumping, vandalism, and encampments.

Trespass authorizations are commonly used by businesses, property managers, and vacant property owners. Your property must be within Walnut Creek city limits.

The form also includes emergency contact information so we can notify you in the event of an emergency, such as a fire or robbery.

Important Update:
Pursuant to SB 602, all Trespass Arrest Authorization forms must now include a notarized signature from the property owner or authorized designee.

Authorizations are valid for:

  • One year, or
  • Up to three years for properties that are posted as closed to the public

You may complete the notarization in one of the following ways:

You may also use any licensed notary public at your own expense.

Proof of Authority

If you are signing as a business representative or property manager, you may be asked to provide documentation showing you are authorized to act on behalf of the property owner.

Acceptable documentation may include:

  • Business license
  • Property management agreement
  • Letter of authorization from the property owner

Submit a signed trespass arrest authorization

Follow these steps to submit a trespass authority letter.

  1. Download the trespass arrest authorization form.
  2. Complete all required fields, including a notarized signature. 
  3. Return it to the police department by:
